• We sell only first quality fabric, leather and vinyl.
• We are making all reasonable efforts to maintain and increase the accessibility of our website. For more information, please check our web accessibility policy. When choosing to use our website please keep in mind that we also offer all the same service by telephone at 1-800-860-3105.
• All of our fabric and vinyl are rolled on long, firm cardboard tubes to keep them wrinkle free. The rolled fabric is then packaged in a plastic sleeve for protection during transit.
• Most of our fabrics can be sampled. This eliminates all guesswork on your part regarding color, texture, pattern, weight, etc.
• Samples are sent by 1st class mail or expedited and can be sent to any address including P.O. Boxes. However for merchandise an actual street address is required.
• Our yardage calculator will provide you with estimated yardage needed for your upholstery project(s). Please keep in mind:
  • If you are purchasing a fabric without a pattern, always order slightly more than you think you may need as we can not guarantee the dye-lot of a future purchase should you need more.
  • Our yardage calculator chart assumes a plain fabric where a pattern does not need to be matched. For patterns that you wish to match, we recommend ordering an additional 15%.
• Orders are usually shipped within 1 business day but may take up to 5 business days on occasion.
• For purchases less than 5 yards, ground shipping is subject to carrier calculated charges.
• For purchases shipping to Alaska, Hawaii, Puerto Rico, and Canada shipping will be charged on a per order basis. Please e-mail or call Customer Service and we will gladly provide you with the shipping charge and time needed in transit prior to placing your order.
• If you are interested in receiving your order quicker please contact us for shipping quotes.
• We guarantee all our fabrics for manufacturing defects for the life time of the fabric. On average fabrics are expected to last 5 to 10 years under normal use when applied properly. We will send you replacement fabric free of charge. The warranty does not include the cost of labor.
• Our warranty covers issues like fabric flaws, color fading, and texture irregularities that occur due to manufacturing defects. The warranty covers normal use and care of the fabric. Misuse, abuse, improper craftsmanship, or improper maintenance will void the warranty. Normal wear and tear, such as pilling or minor fading over time, is not covered.
• Our extended warranty program provides extra protection for your fabric purchase at an additional cost. This program not only includes the benefits of our standard warranty but also offers replacement fabric and reimbursement of your original labor costs if a defect necessitates fabric replacement on your furniture. We strongly recommend this program, as labor costs often represent the most significant expense in furniture upholstery. The warranty is valid for the term specified in your order and becomes effective from the date of purchase, ensuring peace of mind and safeguarding your investment.
• For commercial projects, please review and ensure all your specification and documentation requirements are met for your selected fabric prior to purchase. We are only able to refund unused fabric in its original condition. Restocking fees may apply.
• We inspect our fabric and vinyl but it is important that you do the same because no claims will be allowed after merchandise has been cut.
• If fabric is sent directly to a third party such as an upholstery shop or a designer, please ask for visual confirmation of the pattern or see it in person before use. No return claims can be honored for cut material.
• We check and double check orders before they ship; however, if you receive the wrong merchandise, please email or call our customer service immediately. We will ship your order immediately and issue a pick up for the incorrect one at our expense.
• Once your order has shipped, you will be sent a tracking number via e-mail. If you would like to track your order, simply click on that tracking number.
• If you have placed an order and would like to change or cancel it, call or email Customer Service immediately to determine if your order has shipped. Please provide us with your first name, last name and email address. Once your order has shipped which is within 1 business day of placing your order, it is not possible to cancel it. However, you may return your merchandise for any reason within 30 days of the shipment date - in which case a refund will be processed for your original purchase price less a 15% restocking fee once we receive the merchandise back in its original, uncut condition. Original shipping charges will not be refunded and return shipping charges are your responsibility.
• Our minimum order is 1 yard. After 1 yard, we sell in 1/4 yard increments.
• We accept all major credit cards, debit cards, and money order/cashier check. We also accept personal checks with a 10 day delay in shipping.
• Credit card and debit card purchases will be charged immediately when your order is placed.
• If an order is lost we will handle all the necessary paperwork. We insure all of our shipments and will reship your merchandise at no charge to you.
• If an order is damaged in transit we will contact UPS and reship your damaged merchandise at no charge to you. Please keep all shipping material for UPS to pick up or inspect at a specified date. Please notify us immediately upon receipt of damaged merchandise.
• Your email address will be added to our mailing list automatically so you may receive special offers and free sample promotions. You will be able to opt out of the list any time.
• BINDING ARBITRATION AND CLASS ACTION WAIVER: Any dispute, claim, or controversy arising out of or relating to this agreement, your purchase, or your use of our products or services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. You and KOVI Fabrics each waive the right to a trial by jury and the right to participate in a class action lawsuit or class-wide arbitration. The arbitration shall be conducted by a single arbitrator in the state where KOVI Fabrics is located, and the arbitrator's decision shall be final and binding. This arbitration provision applies to all claims, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory.
• LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOVI FABRICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF KOVI FABRICS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL KOVI FABRICS' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
• DISCLAIMER OF WARRANTIES: EXCEPT AS EXPRESSLY SET FORTH IN OUR MANUFACTURING DEFECT WARRANTY, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. KOVI FABRICS DISCLAIMS ALL OTHER WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• GOVERNING LAW AND VENUE: These terms shall be governed by and construed in accordance with the laws of the state where KOVI Fabrics is incorporated, without regard to conflict of law principles. Any arbitration or legal proceeding shall take place exclusively in that state.
• STATUTE OF LIMITATIONS: You agree that any claim or cause of action arising out of your use of our products or services must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred, regardless of any statute of limitations that might otherwise apply.
• SEVERABILITY: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.
• FORCE MAJEURE: KOVI Fabrics shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, or supply chain disruptions.
• INDEMNIFICATION: You agree to indemnify, defend, and hold harmless KOVI Fabrics, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of products, violation of these terms, or breach of any representation or warranty made by you.
• ACCEPTANCE OF TERMS: By purchasing from KOVI Fabrics, placing an order, or using our services, you acknowledge that you have read, understood, and agree to be bound by all these terms and conditions, including the arbitration clause and limitation of liability provisions. These terms constitute the entire agreement between you and KOVI Fabrics regarding your purchase and supersede any prior agreements or understandings.
